Cancellation, Return and Refund Policy

This Cancellation, Return and Refund Policy ("Policy") applies to purchases made through SparesHub.com, operated by Iradium Automobiles Private Limited under the brand SparesHub.

Automobile spare parts are frequently sourced specifically against a buyer's vehicle details, VIN/chassis number, part number or individual requirement. Accordingly, cancellations and returns are restricted and are permitted only in the circumstances stated in this Policy. By placing an order through SparesHub.com, you agree to this Policy.

2. GENERAL POLICY

All orders placed through SparesHub.com are considered confirmed once payment and the applicable order-confirmation process have been completed. There is no general "change of mind" return or refund facility. A product cannot ordinarily be cancelled, returned or refunded merely because:

  • the buyer no longer requires the product;
  • the vehicle has been repaired elsewhere;
  • the customer of a garage or workshop has cancelled the repair;
  • the buyer subsequently found a lower price elsewhere;
  • the buyer ordered excess quantity;
  • the buyer selected or provided an incorrect part number;
  • incorrect vehicle information was supplied;
  • the buyer misunderstood the product description despite correct information being provided; or
  • the buyer simply changes their mind.

Buyers must therefore verify their requirements carefully before confirming an order.

3. ORDER CANCELLATION BEFORE PROCUREMENT OR DISPATCH

A buyer may request cancellation immediately after placing an order. Cancellation is not automatic and remains subject to whether procurement, processing, packing or dispatch has commenced. If the product has not yet been procured, committed to a supplier, processed or dispatched, SparesHub may approve cancellation at its discretion. Once procurement has been initiated or a supplier has been commercially committed against the buyer's order, the order may become non-cancellable.

4. SPECIAL-ORDER AND SPECIFICALLY PROCURED PARTS

Parts specifically sourced or ordered against:

  • VIN/chassis number;
  • vehicle registration;
  • specific vehicle variant;
  • specific part number;
  • buyer-confirmed quotation;
  • backorder;
  • dealership order;
  • manufacturer order;
  • imported requirement; or
  • other customer-specific requirement

are generally non-cancellable and non-returnable after procurement has been initiated. This applies even where the product has not yet physically reached the buyer.

5. WHEN A RETURN MAY BE ACCEPTED

Subject to verification, a return request may be considered where:

  • a materially different product from the confirmed order was supplied;
  • an incorrect part number was supplied despite the buyer providing correct information and SparesHub confirming a different correct part;
  • the quantity delivered is different from the invoiced quantity;
  • the product was materially damaged before delivery;
  • the product is materially different from the description against which the order was confirmed;
  • the product supplied is counterfeit where it was expressly sold as genuine; or
  • another return right is mandatorily available under applicable law.

Acceptance of a return is subject to inspection and verification.

6. REPORTING PERIOD

Any claim for: incorrect product; incorrect quantity; visible transit damage; missing item; or materially different product must be reported to SparesHub within 48 hours of delivery. Claims submitted after this period may be rejected except where applicable law requires otherwise. The buyer should not install, use, modify or damage the product while a return claim is being reviewed.

7. EVIDENCE REQUIRED

To evaluate a return, shortage or damage claim, SparesHub may require:

  • order number;
  • invoice;
  • photographs of the product;
  • photographs of the packaging;
  • photographs of manufacturer labels;
  • photographs showing the part number;
  • photographs of damage;
  • parcel/shipping label;
  • VIN/chassis information;
  • unboxing video;
  • installation details; and/or
  • other information reasonably necessary to investigate the claim.

Failure to provide sufficient evidence may result in rejection of the claim.

Unboxing Evidence

For high-value, fragile, electronic or multiple-item shipments, buyers are strongly advised to record a continuous video while opening the parcel. Where a shortage, wrong-item or transit-damage claim cannot otherwise reasonably be verified, absence of adequate evidence may affect our ability to approve the claim.

8. CONDITION OF RETURNED PRODUCTS

Unless the claim concerns a condition that necessarily required opening or inspection, a returned product must ordinarily be:

  • unused;
  • uninstalled;
  • unmodified;
  • undamaged after delivery;
  • complete;
  • in its original packaging;
  • accompanied by labels and identification markings; and
  • accompanied by accessories or components originally supplied.

SparesHub may reject a return where the product has been installed, used, altered, painted, repaired, modified or damaged after delivery.

9. INSTALLED OR USED PARTS

Installed or used automobile spare parts are generally non-returnable. Installation can alter the condition of a part and make it impossible to determine whether damage resulted from: manufacturing; transportation; incorrect installation; incorrect diagnosis; another defective vehicle component; or improper use. A manufacturing-defect claim for an installed part will therefore normally be handled under the applicable manufacturer or supplier warranty process rather than as a standard return.

10. ELECTRICAL AND ELECTRONIC PARTS

Electrical and electronic components may be subject to additional return restrictions. Such products may include: sensors; ECUs; control modules; switches; electronic assemblies; lighting electronics; relays; motors; and other electrical components. Once installed, programmed, coded, connected or used, such products are ordinarily non-returnable unless covered by an applicable warranty or mandatory legal right.

11. WRONG PART ORDERED BY BUYER

Where the buyer independently provides or confirms a part number and SparesHub supplies that exact part number, the product will ordinarily not be eligible for return merely because it does not fit the buyer's vehicle. The buyer is responsible for ensuring that independently supplied part numbers are correct. Where SparesHub specifically recommends or confirms a part number based on accurate VIN or vehicle information provided by the buyer, any alleged identification error will be investigated separately.

12. PACKAGING DIFFERENCES

A return will not ordinarily be accepted solely because:

  • packaging design has changed;
  • the manufacturer has changed packaging;
  • a manufacturer label looks different from an older version;
  • the country of manufacture differs;
  • colour or appearance varies slightly;
  • a superseded part number has been supplied; or
  • the manufacturer has replaced an older part number with a newer compatible part number,

provided the product supplied is otherwise genuine, correct and suitable for the intended application.

13. SUPERSEDED PART NUMBERS

Automobile manufacturers frequently replace older part numbers with revised or superseded part numbers. Supply of an officially superseded or replacement part number will not by itself constitute supply of an incorrect product.

14. TRANSIT DAMAGE

If a shipment arrives visibly damaged, the buyer should:

  • record the condition of the parcel;
  • photograph the damaged packaging;
  • record an unboxing video where possible;
  • note the damage with the courier or transporter where possible; and
  • notify SparesHub within 48 hours.

The buyer should retain the complete packaging until the claim is resolved. Claims may be subject to investigation with the relevant logistics provider.

15. DELIVERY SHORTAGE

If any item is missing from a shipment, the buyer must notify SparesHub within 48 hours of delivery. SparesHub may verify: packing records; shipment weight; warehouse records; seller records; photographs; CCTV footage where available; and logistics-provider records before approving the claim.

16. RETURN AUTHORISATION

Products must not be returned without prior approval from SparesHub. The buyer must first raise a return request and receive return instructions. Sending a product back without authorisation does not automatically create an entitlement to a refund, and SparesHub may refuse unauthorised returns.

17. RETURN SHIPPING

Where a return is approved because an incorrect or materially defective product was supplied due to an error attributable to SparesHub or the relevant marketplace seller, SparesHub may arrange or reimburse reasonable return transportation. Where a discretionary return is exceptionally approved despite there being no error attributable to SparesHub or the seller, the buyer may be required to bear:

  • return freight;
  • forward freight;
  • packaging costs;
  • payment gateway charges where non-recoverable; and
  • other actual non-recoverable transaction expenses,

to the extent permitted by applicable law.

18. INSPECTION OF RETURNED PRODUCT

Approval of a return request does not necessarily constitute final approval of a refund. Returned products may be inspected after receipt. SparesHub may reject or adjust a claim if inspection indicates that:

  • a different product was returned;
  • serial numbers or part numbers do not match;
  • the product was used or installed;
  • the product was damaged after delivery;
  • parts or accessories are missing;
  • packaging or labels were manipulated;
  • the product was altered; or
  • the original claim was materially inaccurate.

19. REFUND PROCESS

Once a refund is approved after any required verification or inspection, SparesHub will initiate the refund using an appropriate payment method. Where reasonably possible, the refund may be processed to the original payment method. Depending on the payment method, bank, payment gateway and financial institution involved, the amount may take additional business days to appear in the buyer's account after initiation.

20. REFUND AMOUNT

For an approved claim caused by an error attributable to SparesHub or the relevant seller, the eligible refund will ordinarily include the amount paid for the affected product. Applicable shipping or other charges may also be refunded where appropriate based on the circumstances of the claim. Amounts relating to products correctly supplied and retained by the buyer will not be refunded merely because another item in the same order is returned.

21. REPLACEMENT INSTEAD OF REFUND

Where appropriate, SparesHub may offer a replacement for an eligible incorrect, damaged or defective product. Where replacement is reasonably available and accepted by the buyer, the claim may be resolved through replacement rather than refund. Nothing in this provision limits any mandatory remedy available under applicable law.

22. DELIVERY DELAYS

Delivery dates and ETAs communicated through the Platform are generally estimates unless expressly guaranteed in writing. A delay by itself does not automatically create an entitlement to compensation. Where an order cannot reasonably be fulfilled or is materially delayed before dispatch, SparesHub may offer cancellation and refund depending on the circumstances. Orders already dispatched may be subject to the normal delivery and return process.

23. MANUFACTURER WARRANTY CLAIMS

A product with a manufacturing defect may be subject to the warranty policy of the manufacturer, supplier or seller. Warranty approval may require: inspection; diagnostic report; installation invoice; vehicle information; service history; photographs; return of the defective product; or manufacturer/dealership evaluation. SparesHub does not guarantee approval of a manufacturer's warranty claim.

24. LABOUR AND CONSEQUENTIAL COSTS

Unless expressly agreed otherwise in writing, refunds or replacements do not cover: labour charges; installation charges; removal charges; diagnostic expenses; towing; vehicle downtime; loss of income; loss of business; rental vehicle costs; or other consequential expenses.

25. MARKETPLACE SELLER PRODUCTS

Some products available through SparesHub.com may originate from third-party marketplace sellers. SparesHub may facilitate the return, replacement or refund process between the buyer and seller. Sellers are required to comply with applicable marketplace rules and applicable law. However, the eligibility of a particular product for return may depend on the product, seller, reason for return and transaction circumstances.

26. FRAUDULENT OR ABUSIVE CLAIMS

SparesHub reserves the right to reject claims reasonably determined to involve: product substitution; manipulated photographs; false damage claims; false shortage claims; altered packaging; installation damage; return of used parts; return of a different part; fabricated documentation; or repeated abuse of the return process. Accounts involved in suspected fraud or systematic abuse may be restricted or suspended. SparesHub may take appropriate legal action in cases of fraud.

27. BUSINESS AND B2B PURCHASES

Many transactions on SparesHub.com are business-to-business transactions involving garages, workshops, retailers, distributors, dealerships and other commercial buyers. Commercial buyers are expected to exercise appropriate care when verifying: vehicle information; part numbers; quantities; prices; specifications; and commercial terms before confirming an order. Nothing in this Policy limits rights that cannot legally be excluded under applicable law.

28. POLICY CHANGES

SparesHub may modify this Policy from time to time to reflect changes in Platform operations, marketplace rules, logistics processes or applicable law. The version applicable to a transaction will generally be the version in effect when the relevant order was placed, subject to mandatory legal requirements.

29. GOVERNING LAW AND JURISDICTION

This Policy is governed by the laws of India. Subject to mandatory rights and jurisdiction available under applicable law, courts having jurisdiction in Pune, Maharashtra shall have exclusive jurisdiction over disputes relating to this Policy.
